Terms of service & purchase
Effective
These terms explain website use, purchases, custom orders, and onsite experiences with PrintQuest, a trade name of Hedges & Associates LLC. Please read them before placing an order or joining an activity.
1. Who we are & how these terms apply
“PrintQuest,” “we,” “us,” and “our” mean Hedges & Associates LLC, operating as PrintQuest. “You” means the person using the website or entering into a purchase or service agreement with us. If you order for an organization, you must have authority to bind it.
Our website provisions govern permitted use of this site. Purchase and activity provisions form part of your agreement when we make them available before the transaction and you agree to them, such as through an accepted quote, order form, or checkout acknowledgment. A link on a receipt after payment does not, by itself, add terms to a completed purchase. Sending an inquiry is not acceptance of an order or an activity waiver.
An order-specific agreement accepted by both parties controls any conflict with these general terms for that order. Applicable law and rights that cannot lawfully be waived always take priority. These terms do not retroactively change an existing agreement.
2. Adult purchasers & supervision
Purchases, bookings, and custom-order approvals must be made by an adult who can enter a binding agreement. Please use an adult’s contact details for inquiries. A parent or responsible adult must choose age-appropriate products, follow the product’s instructions, and supervise children. An event host cannot waive another person’s or child’s legal rights simply by placing a group order.
3. Inquiries, orders & payment
This website provides information and accepts inquiries; it does not currently provide online checkout. A message, automated reply, or discussion of availability does not reserve a date, start production, or confirm an order. An advance order or booking is confirmed when we expressly accept the scope, price, timing, and payment arrangements. In-person purchases are confirmed at the point of sale.
Prices, quantities, options, applicable taxes, and any delivery or service charges are confirmed before payment. Pay only through a method we identify and with authorization to use it. Any deposit, balance due date, or cancellation charge must be disclosed and agreed before it applies. We may decline an order for unavailable stock, an unsafe or unlawful request, suspected fraud, or another legitimate business reason, subject to applicable law.
We may correct website or pricing errors before accepting an order. If an error affects an accepted order, we will contact you to agree on a correction or cancellation and any refund due; we will not impose an unapproved price increase. Estimated timing is not a guaranteed deadline unless we expressly agree otherwise. If a covered shipment is delayed, we will provide the notice, choice to accept the delay or cancel, and refund required by law.
4. Custom & bulk orders
Review spelling, artwork, sizes, colors, quantities, and any proof carefully before approving production. You are responsible for the accuracy of the details you supply and approve; we remain responsible for producing the agreed order. Screens and samples may show colors differently from the finished item. Any essential color match, fit, or tolerance must be agreed before production.
Changes after approval may affect cost and timing and require a revised agreement. Custom work may involve materials or production costs that cannot be recovered, but a cancellation charge or nonrefundable amount applies only if disclosed and agreed in advance and permitted by law. Approval does not excuse a defect or our failure to meet the agreed specifications.
5. Returns, cancellations & problems
ALL SALES ARE FINAL. WE DO NOT ACCEPT RETURNS OR OFFER EXCHANGES OR REFUNDS FOR A CHANGE OF MIND. ANY VOLUNTARY EXCEPTION IS AT THE SOLE DISCRETION OF PRINTQUEST’S OWNER. THIS POLICY DOES NOT LIMIT REMEDIES OR CANCELLATION RIGHTS REQUIRED BY LAW.
Contact us before returning an item. The owner may approve an exception case by case; an exception does not change this policy or guarantee the same outcome on another purchase. This policy applies to standard, custom, and personalized products. Separate advance-order and event cancellation arrangements must be disclosed and agreed before the order or booking is confirmed.
If an item arrives damaged, is incorrect, has a defect, or appears unsafe, stop using it and contact us promptly with the purchase date, a description of the issue, and proof of purchase if available. We may request photographs or an inspection to assess the concern. Do not send payment-card details or return an item before receiving return instructions.
We will assess the issue and provide any repair, replacement, refund, or other remedy required by applicable law or an agreed warranty. A final-sale label, customization, a request for prompt notice, or normal print variation does not remove rights concerning defective, unsafe, misdescribed, or undelivered goods. Statutory cancellation periods, refund rights, and payment-dispute rights remain available where they apply.
6. 3D-printed products & care
3D printing can produce visible layers, seams, and small surface or color variations. These characteristics are not automatically defects, but they do not excuse unsafe products or a material difference from an agreed description. Photographs may show examples or designs in development; the actual items and features included in your purchase are those confirmed at sale.
Printed plastics can break or deform under heat, impact, bending, or excessive force. Follow the instructions supplied with your item. Keep it away from flames, hot vehicles, dishwashers, and other heat sources unless its instructions specifically permit that use. Inspect moving parts and connections before use; stop using an item with cracks, loose pieces, sharp broken edges, or other damage. Do not alter a product in a way that creates a hazard.
7. Product safety & intended use
- Follow the age guidance and warnings for the specific item. Products with small parts present a choking hazard and must be kept away from children under three and anyone who may mouth objects. Adult supervision does not make an unsuitable product suitable for a younger child.
- Toy swords, printed handles, and foam or pool-noodle components are for supervised imaginative play. They are not weapons, protective equipment, or equipment for contact sparring. Do not strike people or animals, aim at the face, eyes, head, or neck, or use broken or unsecured components. Foam does not eliminate the risk of injury.
- Unless expressly identified for that purpose, our products are not for food contact, chewing, medical use, lifesaving use, electrical protection, or supporting body weight or other safety-critical loads.
- Keep paint and craft materials out of mouths and eyes, follow their labels, and protect clothing and surfaces. Materials may stain or cause irritation; tell staff about a relevant concern before participating and stop if irritation occurs.
Misuse, damage, and failure to follow instructions can create hazards. These precautions do not release PrintQuest from its own legal responsibilities or replace product-specific warnings.
8. Onsite experiences & events
The Forge, Print & Paint, and other activities depend on the options and arrangements confirmed for the event. Children must remain under the supervision of their parent or responsible adult; participation does not include childcare. Follow staff directions and venue rules. We may pause or end unsafe, abusive, or disruptive participation, subject to applicable refund rights.
For an arranged group event, the host is responsible for the permissions, access, suitable space, and adult supervision assigned to the host in the booking agreement. Weather, venue restrictions, illness, or events beyond reasonable control may affect delivery. We will communicate changes and address rescheduling, cancellation, and amounts due back under the agreed terms and applicable law; this is not an automatic forfeiture of payments for unprovided work.
Any separate participation release or photo permission must be presented and agreed separately where needed. Buying an item or attending an activity does not, under these terms, grant permission to use your or your child’s image in advertising.
9. Website use & availability
Use the site lawfully. Do not submit fraudulent or infringing material, impersonate someone, send spam, introduce malicious code, bypass security controls, or disrupt the site. We may restrict abusive access and remove unlawful content as permitted by law. Such action does not erase obligations on an existing paid order.
We may update, suspend, or discontinue website features. General website information may contain errors or become outdated. Confirm important product, availability, and event details with us before relying on them. We do not promise uninterrupted or error-free website access.
10. Designs, content & customer materials
Website text, photographs, branding, and designs belong to PrintQuest or their respective owners and are protected where applicable by intellectual-property law. You may browse, share links, and save these terms for your records. Other reproduction or commercial use requires the relevant owner’s permission unless allowed by law. Buying a physical item does not transfer copyright, a source design file, or a license to reproduce the design.
If you provide artwork, names, logos, files, or other material for an order, you represent that you have the rights and permissions needed for that use. You give us permission to use that material only as needed to quote, produce, and fulfill the order. You retain your existing rights. We may refuse material that reasonably appears unlawful or infringing; accepting it is not legal clearance.
For business-to-business orders, to the extent permitted by law, the business customer agrees to reimburse us for reasonable losses and legal costs from a third-party intellectual-property claim caused by our authorized use of material that customer supplied without the necessary rights. This does not cover our independent designs, unauthorized changes, or our own wrongful conduct. We will give prompt notice and a reasonable opportunity to participate in the defense; no settlement imposing an obligation on the customer will be made without its consent, not unreasonably withheld.
11. Privacy & third-party services
Our privacy notice explains website inquiries, security, and optional analytics. An inquiry or purchase does not automatically sign you up for marketing. Do not send sensitive personal information or payment-card details through the contact form.
Third-party websites, venues, and payment services have their own terms and privacy practices. A link does not mean that we control or endorse all of their content. Their involvement does not remove PrintQuest’s responsibility for its own products, services, or legally required refunds.
12. Warranties & website disclaimer
Products and services remain subject to their agreed descriptions, any applicable express warranty, and warranties and remedies required by law. These general terms do not disclaim statutory implied warranties for consumer goods or promise a separate lifetime, durability, or satisfaction warranty. Damage caused by misuse, alteration, or normal wear is different from a defect present at sale; your legal rights depend on the circumstances.
TO THE EXTENT PERMITTED BY LAW, THE WEBSITE ITSELF IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THIS WEBSITE DISCLAIMER DOES NOT APPLY TO WARRANTIES ON PRODUCTS OR SERVICES YOU PURCHASE, EXPRESS PROMISES WE MAKE, OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.
13. Limits of liability
TO THE EXTENT PERMITTED BY LAW AND SUBJECT TO THE EXCEPTIONS BELOW, HEDGES & ASSOCIATES LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE UNDER THESE TERMS FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL LOSSES, INCLUDING LOST BUSINESS PROFITS OR LOST BUSINESS OPPORTUNITIES. FOR CLAIMS TO WHICH THIS LIMIT MAY LAWFULLY APPLY, OUR TOTAL LIABILITY ARISING FROM A PARTICULAR ORDER WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THAT ORDER; FOR WEBSITE-ONLY CLAIMS UNRELATED TO A PURCHASE, THE LIMIT IS $100.
THESE EXCLUSIONS AND CAPS DO NOT APPLY TO DEATH OR PERSONAL INJURY, DAMAGE TO TANGIBLE PROPERTY CAUSED BY A DEFECTIVE PRODUCT, FRAUD, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY LIABILITY, WARRANTY REMEDY, REFUND, OR CONSUMER RIGHT THAT THE LAW DOES NOT ALLOW US TO EXCLUDE OR LIMIT. THEY DO NOT REQUIRE YOU TO RELEASE CLAIMS FOR OUR NEGLIGENCE CAUSING INJURY OR WAIVE PRODUCT-SAFETY RIGHTS.
Some jurisdictions do not allow particular limitations; in those places they apply only to the extent legally permitted. Nothing in these terms guarantees that participation or product use is free of risk, or makes you responsible for harm caused by our unlawful conduct.
14. Concerns, disputes & applicable law
Please contact us with concerns so we can try to resolve them. Include the order or event details and the outcome you are requesting. Contacting us first is encouraged, but it is not a condition that takes away a legal deadline, payment dispute, or right to seek relief.
Hedges & Associates LLC is based in Texas. These terms and agreements incorporating them are governed by Texas law and applicable United States federal law, without applying conflict-of-law rules to select another state’s law. This choice does not deprive you of mandatory consumer protections that apply where you live or to your transaction. These terms do not require arbitration, waive class actions or jury trials, or require you to use an exclusive court. A dispute may be brought in a court with lawful jurisdiction, including an eligible small-claims court. Nothing prevents reporting a concern to a government agency.
15. Changes & general terms
We may revise these terms by posting a new effective date and providing additional notice or obtaining agreement where required. The version agreed for an order continues to apply to that order unless both parties agree to a lawful change. Please save a copy with your order records.
If a provision is unenforceable, it will be set aside to the extent required and the remaining provisions will continue where legally possible. Not enforcing a provision immediately does not waive it. These terms and the accepted order-specific terms form the agreement for their subject matter, without excluding express representations or rights protected by law. Provisions intended to address completed transactions or disputes continue to apply after website use or an order ends.
